When is a Land Registry compliant plan needed?
A Land Registry Compliant Lease Plan is required for several reasons, the most common are:
  • A new lease of 7 or more years is being granted.
  • When a leasehold property is sold, and there are 7 or more years remaining on the term.
  • When land forming part of a registered Title or that has been previously unregistered is being sold.
  • An existing Title is being split into two or more parts.
  • If the demise of a property changes, for instance if a flat builds into the basement or into the roof, or an extension is added.
What makes a plan Land Registry compliant?

Since 2002 it has become law for lease plans to be compliant with the Land Registry guidelines. For a lease plan to be compliant, it must include the following:
  • Lease Plan drawn to scale, preferred scales are 1:100 & 1:200
  • A Location Plan, scaled at 1:1250 or 1:2500
  • Show a North Point
  • Show sufficient detail to be identified on the Ordnance Survey map.
  • Include any land associated with the property, including gardens, paths and garages.
  • Clearly indicate the separate parts of the property, such as the house, parking, gardens, bin areas etc.
  • Identify any varying floor levels (where required).
  • Show its general location, by showing roads, road junctions and other landmarks.
  • Clearly identify demised areas, communal areas and external demised areas by either edging, colouring or hatching.
  • Show a scale bar and a plan key.
  • Show buildings in their correct or intended position.
  • Show measurements that correspond to scaled measurements (as much as possible).
  • Show intricate boundaries with a larger scale or inset plan.
  • Not to be marked as 'for identification purposes only' or other disclaimers.
What happens if i do not provide a compliant Land Registry plan?
If the plan that is attached to the lease is not Land Registry compliant, then it is very likely that the Land Registry will reject the application.

At the very least they will have questions and may request amendments are made to the plans, so it really saves time to have them drawn correctly in the first place.

This of course could lead to a delay in getting the lease registered, which has a knock on effect to all parties involved in the process.

The application will have to be re-submitted, and will most likely involve further costs having to have the plan drawn again.

So for instance, an average sized 2 bed flat or a small high street shop would most likely be included within the minimum fee. Where as a large office, a country house or a large commercial unit would be charged at a higher rate.

The majority of plans are delivered to the client no later than 48hrs from the initial site visit, with most plans provided within 24hrs.
